6. Our Lawful Bases
UK data-protection law requires us to have a lawful basis for using personal information.
Depending on the circumstances, we may rely on:
Contract
We use information where it is necessary to provide a service you have requested or to take steps before entering into an agreement with you.
This may include processing bookings, taking payments, arranging activities and communicating information needed to deliver a programme.
Legal obligation
We may use information where this is necessary to meet legal, financial, insurance, safeguarding or regulatory responsibilities.
Legitimate interests
We may use information where it is reasonably necessary to operate and improve Burners Basecamp, provided that these interests are not overridden by your rights and interests.
This may include responding to enquiries, maintaining appropriate records, improving our services, protecting participants and managing relationships with partners.
Consent
We rely on consent where appropriate, including for certain marketing communications, promotional photographs and video, and some uses of health information.
You may withdraw consent at any time. Withdrawal does not affect processing that took place before consent was withdrawn.
Vital interests
In an emergency, we may use or share information where this is necessary to protect someone’s life or physical safety.
Protected
We use appropriate technical and organisational measures to protect your information.
Used responsibly
Your information is used only for the purposes described in this notice.
Never sold
We do not sell or rent your personal information to anyone.
7. Health and Other Special-Category Information
Health information is classed as special-category personal data.
When we collect and use health information, we identify both:
-
a lawful basis under Article 6 of the UK GDPR; and
-
an additional condition under Article 9 of the UK GDPR.
For routine collection of medical information needed to support safe participation, we will normally seek explicit consent from the participant or, where appropriate, their parent or guardian.
In an emergency where someone is unable to provide consent, we may use relevant information where necessary to protect their vital interests.
We restrict access to health information to people who reasonably require it for safety, safeguarding, administration or emergency purposes.
9. Photographs, Video and Testimonials
We may take photographs or recordings during coaching, programmes and events.
Identifiable photographs, video or testimonials may be used on our website, social-media channels, printed materials or other promotional communications where we have an appropriate lawful basis and, where required, consent.
Consent for promotional media is separate from agreement to participate in an activity. Refusing promotional-media consent will not prevent someone from participating.
You may withdraw consent for future use by contacting us. Where reasonably possible, we will stop further use and remove material under our control. However, it may not always be possible to recall material that has already been printed, shared or published by others.
11. Sharing Information
We only share personal information where it is necessary and lawful.
Depending on the service, information may be shared with:
-
Burners Basecamp coaches, staff, contractors and volunteers;
-
event staff and safety coordinators;
-
accommodation, transport and activity providers;
-
co-hosts, federations, clubs, venues or partner organisations;
-
booking, website, email, cloud-storage and communication providers;
-
banks, accounting providers and financial advisers;
-
insurers, professional advisers and regulatory bodies;
-
emergency services and medical professionals;
-
safeguarding authorities; and
-
law-enforcement agencies or courts where legally required.
We only share the information reasonably necessary for the relevant purpose.
Where an organisation processes information on our behalf, we take reasonable steps to ensure that appropriate confidentiality, security and data-protection arrangements are in place.
Our website is provided through Wix, which may process website information on our behalf in accordance with its own privacy and security arrangements.
8. Children and Young People
Burners Basecamp provides services involving children and young people. We take additional care when collecting and using their information.
We may collect information about a child or young person when a parent or guardian:
-
makes an enquiry;
-
completes a registration;
-
provides emergency or medical information;
-
gives permissions or consent; or
-
communicates with us about their participation.
We use this information only for specified purposes, including:
-
administering activities;
-
communicating with the participant and their parent or guardian;
-
providing appropriate coaching and support;
-
protecting health, welfare and safety;
-
meeting safeguarding responsibilities; and
-
using photographs or video where appropriate permission has been provided.
We aim to explain our use of information in language appropriate to the age and understanding of the young person.
We do not knowingly use children’s personal information for unrelated marketing or profiling.
10. Marketing Communications
We may send news, programme information or promotional communications where:
-
you have specifically consented; or
-
the law otherwise permits us to contact an existing customer about similar services and an appropriate opt-out was provided.
You can unsubscribe at any time by:
-
using the unsubscribe link in an email;
-
following the instructions in the message; or
-
contacting info@burnersbasecamp.com.
Withdrawing from marketing will not prevent us from sending essential information about a booking, programme, payment, safety matter or existing relationship.
We do not sell personal information or provide it to other organisations for their independent marketing.
12. International Transfers
Some of our technology providers, event partners or service providers may process personal information outside the United Kingdom.
We may also need to share limited information with accommodation providers, activity providers or event partners when delivering international trips or programmes.
Where this involves a restricted transfer of personal information, we use a transfer mechanism permitted under UK data-protection law. This may include:
-
UK adequacy regulations;
-
approved contractual safeguards;
-
the UK International Data Transfer Agreement;
-
the UK Addendum to approved contractual clauses; or
-
another legally permitted exception.
Where required, we assess whether the information will receive an appropriate level of protection.
You may contact us for further information about the safeguards used for international transfers.
13. How Long We Keep Information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, insurance and safeguarding purposes.
Our usual retention approach is:
General enquiries
Normally retained for up to two years after our last meaningful contact.
Booking, contractual and financial records
Normally retained for six years after the end of the relevant financial year or service.
Routine participant and programme records
Normally retained for up to three years after the participant’s last activity with us.
Emergency and routine medical information
Normally deleted or securely anonymised within three months of the relevant activity, unless it is connected with an accident, safeguarding concern, insurance matter or continuing service.
Accident, safeguarding and insurance information
Retained for the period reasonably required by applicable law, safeguarding guidance, insurance requirements and relevant limitation periods.
Coaching and performance records
Retained while the coaching relationship remains active and normally for up to three years afterwards, unless there is a continuing reason to retain them.
Marketing information
Retained until you unsubscribe or we determine that it is no longer needed. We may retain limited information on a suppression list to ensure that we respect an opt-out.
Photographs, video and testimonials
Retained for as long as they remain relevant to the purpose for which they were collected, subject to periodic review and any withdrawal of consent.
We may retain information for longer where required by law, where an insurance or safeguarding matter remains open, or where it is needed to establish, exercise or defend a legal claim.
When information is no longer required, we delete it securely or anonymise it.
14. Data Security
We use appropriate technical and organisational measures to protect personal information against:
-
unauthorised access;
-
accidental loss;
-
inappropriate disclosure;
-
alteration;
-
misuse; and
-
destruction.
These measures may include:
-
secure and encrypted platforms where appropriate;
-
restricted access to sensitive information;
-
password and account controls;
-
secure banking arrangements;
-
confidentiality expectations for coaches and contractors;
-
appropriate backups; and
-
regular review of how information is handled.
No internet-based service can be guaranteed completely secure. However, we take reasonable steps appropriate to the nature and sensitivity of the information we hold.
15. Cookies and Similar Technologies
